Contra Costa County granted yesterday a petition filed on behalf of a registrant convicted of PC 288(a) in 1986. This is the second known petition granted by Contra Costa county so far. The first petition granted in Contra Costa county took place on December 2, 2021, for a different registrant convicted of the same offense. In both cases, the District Attorney did not object to the petitions.
“Many courts in California are granting petitions filed by or on behalf of eligible registrants,” stated ACSOL Executive Director Janice Bellucci. “This is encouraging and should provide registrants with an incentive to either file their own petitions or to hire an attorney to do so on their behalf.”
Bellucci has successfully represented six registrants in three different counties (Los Angeles, San Francisco and Contra Costa). In each of those cases, the registrant’s petition was granted and they are no longer required to register.
“The biggest obstacle so far is the failure of the California Department of Justice (CA DOJ) to assign registrants a tier,” stated Bellucci. “Without a tier assignment, most District Attorneys are recommending that courts deny petitions.”
The Tiered Registry Law provides CA DOJ with an additional 48 months to assign the tiers of registrants. The deadline for all tier assignments is January 1, 2023.
In addition to these counties, it is reported that San Diego county has granted 69 petitions and denied 11 petitions thusfar. Of the 11 denied petitions, 4 petitions were denied because the registrant was ineligible to petition. A total of 143 petitions have been filed in San Diego county. The petitions not yet granted or denied are still pending.

I was now I am looking to hire an attorney, I filed my petition in August of last, it’s been 7 months now & my b-day is only 4 months away & I seriously would not want to register again, I’m eligible tier 2. I talked to the district attorney the first time & she mentioned that she didn’t file/send, than I called a few days after now she says it’s a waiting game. I still would like to hire an attorney that has knowledge & has had success. any recommendations? based in Southern California, Los Angeles

The contact phone number (do that first) and email address found in the Tier letter were very helpful in correcting my Tier level and subsequently removing me from the registry.
LA. I obtained a COR in 2021! George Gascon is the DA. My court dates where delayed twice! I know the DA and what court room you will see. My neighbor is the (true story) of one of the courts in LA. Unless you have violated your probation/parole or been arrested multiple times, you should be good. I was in the downtown court Div 100! You will have delays. They literally have 1 retired ex Detective doing background checks 3 days a week. My charges where reduced/17b/expunged. I don’t know your situation. The 2nd time the DA (Asian) Div 100 requested a 2nd delay, he informed my counsel that my presence wouldn’t be required? I was on pens and needles and I had a lot of sleepless nights. I never saw the Judge, never saw the court room and I only saw the DA walk by in the corridor! My request was granted, I was ordered off the registry and my life has changed dramatically! I later called both agencies where I registered and one of the clerks and (I don’t know what LE website they use) I went from TBD – Registration Terminated! Congrats. I then called LB and the guy (clerk) was lost! Lol. I was never called/emailed or visited by either agency conforming this info. I had to reach out. I was just notified my professional license was reinstated 2 weeks ago. So, miracles happen. Have hope! Best of luck. I would like to know if anyone in OC has granted a Registrations request granted? Good luck! LA is very liberal! PS: (very important) I wrote a letter to the court. I took full accountability for my actions. READ): my counsel stated the DA informed her he has had other petitioners not take accountability/blamed his actions on an ex wife/drug use etc! Not granted. Suck it up and take accountability and address how you won’t make the same mistake and why. I rarely read anyone on this site do this. Admit your mistake!’
JAB, I concur. I was initially arrested for (3) 261 & (2) 211!! I had a good attorney, did some digging and caught some lies! I plead to (1) 243.4a wobbler- 5 years summary probation. Later, 17b, expunged and COR. I was informed via my counsel at the COR the DA liked my letter and my presence wasn’t required! She informed me he had past petitioners who blamed their actions on an ex, alcohol etc- denied! I never saw the court room – granted! Then, after (think about the charges) this, I re-applied for a professional license with the medical board’ 5 serious felonies- past registered! Granted! I took accountability; showed I was remorseful; showed how I attended church; started a family; mens groups! Granted! It’s surreal: I concur: just bite the bullet’
Anyone know an attorney to help with my petition? I have called and emailed several and no one has gotten back to me. I’m located in south Orange County. Any help would be appreciated.
Story: by law, if you visit or stay at another residence (ie: LA) once a year, by law you must register at this location! I once knew a guy in OC who also registered in LB! In summary, he registered dual addresses and considered LB his primary. He might visit once a week. He told his relatives/or friend he was applying for a job and he has a better chance if in LA County. Nobody checked and his request was granted easily – LA is super liberal
